Content: You understand that all postings, messages, text, files, images, photos, or other materials ("User Content") posted on, transmitted through, or linked from the Materials Exchange are the sole responsibility of the person from whom such User Content originated. You are entirely responsible for all User Content that you post, communicate, or otherwise make available via the Materials Exchange. You understand that the County does not control, and is not responsible for User Content made available through the Materials Exchange, and that by using the Materials Exchange, you may be exposed to User Content that is inaccurate, misleading, or otherwise objectionable. User Content made available through the Materials Exchange may contain links to other websites, which are completely independent of the County. The County makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. You acknowledge that the County does not pre-screen or approve User Content, but the County shall have the right (but not the obligation) in its sole discretion to refuse, delete, or move any User Content that is available via the Materials Exchange, for violating these Terms of Use.

If there is a dispute between users on this site, or between users and any third party, you understand and agree that the County is under no obligation to become involved.

Waiver and Release: In the event that you have a dispute with one or more other users, you hereby release the County, its officers, employees, volunteers, agents, and successors in rights from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or the Materials Exchange website. Additionally, you waive California Civil Code Section 1542, which says: 'A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her must have materially affected his or her settlement with the debtor.'


Conduct: Your use of the Materials Exchange is subject to the general use standards appearing at http://countyofsb.org/terms.sbc (YOUR USE OF COUNTYOFSB.ORG), and the following:


You agree that any User Content you post will:

    - Be related to natural materials available resulting from the Montecito Debris Flow event;

    - Offer all materials free of charge;

    - Consist of appropriate and relevant language and photos only.

You agree not to post or otherwise make available any User Content that:

    - Is false, deceptive, misleading, deceitful, or misinformative, offensive, or unrelated to natural debris materials;

    - Includes links to commercial services or web sites;

    - Advertises any illegal services or the sale of any items;

    - Impersonates any person or entity, including, but not limited to, a County employee, or falsely states or otherwise misrepresents your affiliation with a person or entity.

Limitations on Service: You acknowledge that the County may establish limits concerning use of the Materials Exchange, including the maximum number of days that Content will be retained on the Materials Exchange site, or the maximum number and size of postings or other User Content that may be transmitted or stored by the Materials Exchange. You agree that the County has no responsibility or liability for the deletion or failure to store any User Content maintained or transmitted by the Materials Exchange. You acknowledge that the County reserves the right at any time to modify or discontinue the Materials Exchange (or any part thereof) or these Terms of Use with or without notice, and that the County shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Materials Exchange.


Privacy: You understand that your use of the Materials Exchange is governed by the County’s website Privacy Policy (http://countyofsb.org/terms.sbc#privacy). You further understand that all User Content posted to the Materials Exchange constitutes a Public Record under California law for as long as that User Content is maintained on the County’s Materials Exchange.
